The LDS Church Responds Worldwide in Light of Franklin Squires Fraud, By Robert Paisola

In the letter, the First Presidency says that “reports of fraud schemes and unwise investments prompt us to again counsel members with respect to prudence in managing one’s financial affairs.” They also stated that they are “concerned that there are those who use relationships of trust to promote risky or even fraudulent investment and business schemes.”

“We are concerned that some church members ignore the oft-repeated direction to prepare and live within a budget, avoid consumer debt, and to save against a time of need.”
“Consideration should also be given to investing wisely with responsible and established financial institutions. We are also concerned that there are those who use relationships of trust to promote risky or even fraudulent investment and business schemes.”

“While all investments carry an element of risk, that risk can be managed by following sound and proven financial principles: first, avoid unnecessary debt, especially consumer debt; second, before investing, seek advice from a qualified and licensed financial advisor; and third, be wise.”

The First Presidency of The Church of Jesus Christ of Latter-day Saints has sent a letter to its congregations, urging members to be wary of fraud.

In the letter being read in churches, the First Presidency says "reports of fraud schemes and unwise investments prompt us to again counsel members with respect to prudence in managing one's financial affairs."

"We are concerned that some church members ignore the oft-repeated direction to prepare and live within a budget, avoid consumer debt, and to save against a time of need," the statement reads.

"Consideration should also be given to investing wisely with responsible and established financial institutions. We are also concerned that there are those who use relationships of trust to promote risky or even fraudulent investment and business schemes."

The LDS Church did not elaborate beyond the First Presidency's statement, but state authorities who investigate financial crimes hope Utahns will "heed the message."

"I hope bishops have read them. It is real critical that they are being read," said Francine Giani, the executive director of the Utah Department of Commerce. "I hope people are listening."

Here in Utah, authorities said a majority of the fraud cases they encounter involve some level of "affinity fraud," which is an investment scam that preys upon members of a specific group — such as a religious or ethnic community.

"It is very prevalent," said Charlene Barlow, the Utah attorney general's section chief over financial crimes. "I have victims that sit here and they say, 'I can't believe I was so stupid. But you know, he was a church member. He was in my ward. He was my bishop.' So they check their skepticism at the door."

Affinity fraud is not limited to the LDS Church, but, obviously, many of the cases here are LDS-centric because it is the dominant faith.

"People that are going to perpetrate a fraud on a group of people, the issue of trust is important," Giani said. "That trust can come from a religious affinity."

Barlow said anecdotally, they find LDS connections do factor into a fraud scheme.

"You'll walk into their office and they'll have their Gospel Doctrine manual laid out there because they're preparing their lesson for Sunday," she said. "I don't know that all of the people are consciously trading on their church affiliation. I've often thought the first person a con man cons is himself."

Recently, the Utah Attorney General's Office filed fraud charges against an Ogden businessman accused of bilking hundreds of investors out of more than $140 million. State securities investigators have alleged that Val Southwick, 62, emphasized his LDS membership while soliciting investors in what prosecutors call a massive Ponzi scheme. Southwick is scheduled to be arraigned March 24.

Barlow said the weight of the LDS Church's statement may be lost on those perpetuating schemes, because they believe the "investment opportunity" will work this time.

"They won't think it applies to them because they're aren't doing it," she said. "They think, 'Yes, you should go after these bad guys, but I'm not one of them."'

Giani hopes those looking to put their money in someone's investment will listen and do their homework, making sure people are licensed and have clean records. Such information can be found by visiting the state's Web site at commerce.utah.gov.

"As a member of the faith, it is always a tragedy to me to uncover many of the details (of a fraud scheme). Frankly, I am much less tolerant of those kinds of situations, because technically we should know better," Giani said.

In its statement, the First Presidency urged its members to know the risks of investing.

This is a formal update to the news release that we issued last night on the victim in St. George, Utah who lost $140,000 with Franklin Squires and Rick Koerber.

We just concluded a phone call interview with the victim who said that he lost $140,000.00 in this scam. He said that he did as we suggested on our web sites and filed an official complaint with the State of Utah and that Mike Hinses (the senior investigator for the State of Utah) sent an investigator to talk to him the very next day.

He said that he gave the State of Utah ove 200 pages of material that he has promised to send to our offices so that we can publish all of the contracts and data for you, our readers, to read.

He also stated that as of February 2007, Koerber made an agreement with the State of Utah that forbade him from taking any kind of monies for investments like this. We will post a copy of that entire agreement soon.

He also said that he will be preparing a VERY DETAILED outline of what happened to him and his family as a result of his investment.

We salute the State of Utah and the Division of Securities for responding so quickly to our readers complaints.

One thing that was said by Mr. Hinses was that this investigation is only beginning. The State of Utah has many victim reports that you have sent to our office that we have not published. We will only release information if you, the victim, provide verbal authorization.

Annuit Coeptis LLC (Gabriel Joseph) Real Estate Ponzi Scheme or Legitimate Business?
I’m hoping that if I post my story about investing with Gabe Joseph and Annuit Coeptis, LLC that others will come forward as well. If you are looking for information about Annuit Coeptis the all seeing eye on the back of the one dollar bill, you have came to the wrong place, this is about a company that has defrauded my family and many others out of money.

The first time I met Gabe was in his office at Franklin Squires, he seemed nice but you could tell he was a salesman. He told us about Rick Koerber and how he was such an “honorable” man. He told the story of how Rick’s company National Business Solutions went under at the end of the ow H .com era. Rick paid back all of his creditors in full with interest. He told us how the money was invested in Founders Capital and very briefly told us about the “Equity Mill TM”. What Gabe never went over is the questions that you have to ask to satisfy the SEC.

The first time we caught “The Invisible Hand” of capitalism and his assistant Brandon Adams in a lie was back in June, Gabe was very late on his July 2007 interest payment and he claimed that he was on a fishing trip and Brandon also claimed he was on a fishing trip. The funny thing is they both thought that the other was taking care of the payments. I guess Gabe forgot that he had to approve the payments. The next month’s interest payment for August 2007 was on time. Starting with September the money stopped and the lies came out in full force.

We thought that Gabe or Brandon would tell us that we were not going to get that month’s interest payment. Instead we got the run around from both Gabe and Brandon. We did find out that others were lucky enough to get their interest payment that month (I wonder how he chose). The story we heard was that he didn’t have any money, Founders Capital wasn’t distributing. Gabe claimed that if Founders wrote a check to him and he cashed it, he would go to jail. He said because the state was investigating Founders Capital. The second lie we were told is that Founders couldn’t payout because their assets were frozen by the state. The third lie that we heard was if they paid money out it would be “discrimination” (whatever that means).

That is contrary to what the State of Utah claims; that they want Rick, Gabe and all of the gang to pay their investors back. The State said that all of their stall tactics and excuses they are giving us are absolutely false. If you want any chance of getting some of your money back, contact the State of Utah Division of Securities. (Contact info is at the bottom of the page). They also claim that they are cooperating with the state, giving financials etc. This is also false. The latest excuse that Gabe is now claiming is that he doesn’t know why Rick is not distributing from Founders Capital. Gabe said that 80% of his money is coming from Founders but 20% is coming from other interests that are doing well. I wonder if he is living off of the 20% because I know investors aren’t seeing it.

We are so very glad that we didn’t get involved with their FranklinSquires University or the Free Capitalist Project. I know a few people that have and it’s like adding insult to injury. Since they use their church affiliation and verbiage to teach their principles it would be interesting what the first presidency would think of their business practices.

Since the fall of Annuit Coeptis I have read many things about Gabe, Rick and FranklinSquires. The only principle that they know or truly believe in is selfishness. It makes me sick to think they have swindled millions of dollars out of investors. Yet they drive around in Ferrari’s and live in their 3 to 5 Million Dollar houses and cabins. I keep thinking that I will see a big billboard with a huge house and a picture of Rick saying this is the house that fraud built. I just can’t understand why they think that they have done nothing wrong. While some investors are losing their houses and others will be paying for their “material possessions” for years to come. I’m not sure how they can feel good about themselves knowing that they have lied, cheated and stole from others. I think they were trying to tell us something with their slogans “Some things are true whether you believe it or not”, “Turn your brain on”.

If you have received a questionnaire from the State of Utah Division of Securities please fill it out in the entirety. They already have copies of your promissory note so they already know the terms of the agreement. The purpose of the questionnaire is to find out if fraud was committed on the part of the issuer and to help get investors monies returned.

Please post your stories and comments so that others may learn more information about the Franklin Squires Ponzi Scheme. This blog isn’t just about Annuit Coeptis it is for anyone that has any dealings with FranklinSquires or subsidiary thereof.
